TERMS AND CONDITIONS
The following terms and conditions apply to any agreement between The Troopers and the client.
1. Booking fees
All booking fees are to be agreed upon by The Troopers on forehand.
All fees are defined excluding 20% agency fee and excluding 21% VAT.
2. Daily and hourly rates
Photography
1 day = 8 hours 0,5 day = 4 hours
Film
1 day = 10 hours 0,5 day = 5 hours
3. Overtime
Overtime is charged as follows
Overtime between 08:00 and 24:00hrs is charged at 1/8 of the daily rate, per hour.
Overtime between 24:00 and 08:00hrs is charged at 1/4 of the daily rate, per hour.
4. Additional fees
Additional fees are applied in case of following usage:
- POS/Instore usage
- Window displays
- Paid social ads
- Bus stops/tram stops/stickers/packaging
- Usage outside of the Netherlands
- Portrait rights for selling artwork which show our model(s)
- Online or offline usage of the name of our talent/model.
- Use of A.I.
The client will always indicate on forehand for what purpose the images will be used.
Otherwise we will give a quotation for optional usage and invoice a buy-out fee accordingly afterwards.
5. Image rights model
The Troopers protects the image rights of the model,
if The Troopers does not approve a certain picture/shoot to be published,
The Troopers has the right to decline the publication/usage of the picture(s).
- No underwear, swimwear, shirtless and nude without prior written permission from the Troopers.
6. Artificial Intelligence
a. Prohibition of Use for AI Training
The Client agrees not to use, nor allow any third party to use, photographs, videos, or any other visual media representing the Model to train, develop, or enhance artificial intelligence models, particularly those intended to generate images, videos, or digital avatars.
b. Limitation on Reproduction and Modification Rights
The use of the images is strictly limited to the specific usage rights expressly granted in writing. Any digital transformation, modification, or adaptation using artificial intelligence technologies (including but not limited to: image generation based on the original, I2V, video synthesis, deepfake, or manipulation of features and poses) is prohibited without written consent and a specific financial compensation.
c. Protection of Image Rights and Biometric Data
The Client acknowledges that the Model’s image constitutes personal data protected under applicable laws (notably the GDPR in Europe). Any extraction, analysis, or storage of physical characteristics for AI exploitation is prohibited.
d. Sanctions for Non-Compliance In case of non-compliance with this clause, the Model or their Agency reserves the right to:
• Demand compensation amounting to at least 100% of the original contract fee
• Initiate legal action for violation of image rights and copyright,
• Demand the immediate removal of any content generated from the original images.
7. Travel expenses
From home base model to shoot location: 0,23 euro per KM.
8. Cancellation fees
Cancellation fees are not applied to:
Cancellations up to 48 hours before shoot days.
Any cancellation at a later time will be charged the total amount agreed upon booking.
For some bookings we have another cancellation policy, which can be found on the booking confirmation.
9. Weather related cancellations
Bookings that require favorable weather conditions need to be clearly indicated as such by the client beforehand.
Only in that case, the client is allowed to cancel free of charge when weather conditions do not meet expectations.
10. Options
Options need to be confirmed by the client as a booking no longer than 24 hours before the booking date.
Confirmed bookings take precedence over options.
11. Exclusivity
Exclusivity rights need to be requested by the client before booking. Additional fees will occur in most cases.
12. Payments
The client will be invoiced by The Troopers on the model's behalf.
Payments are due within 30 days after the invoice date.
The invoice amount is to be paid to the bank account of The Troopers including the invoice reference.
The client remains responsible for the payment of the invoice at all times.
Due invoices: 1% interest per 30 days due.
13. Liability
The Troopers is not liable for damage which may have occurred
if the model has not or not satisfactorily fulfilled any agreement whether or not through the intervention
of The Troopers between the client and the model.
The client is liable for all damage that may result for the model or The Troopers from an (booking)agreement.
14. Dispute settlement
All disputes resulting from present agreement are assessed under Dutch law
and must be brought to the competent court in Amsterdam.
